1. Scope

("Provider") and users of the WaveMaster platform ("User").

By accessing or using the platform, the User agrees to these Terms.

2. Nature of the Service

WaveMaster provides:

  • educational content
  • market commentary
  • market observations
  • trading ideas
  • analytical tools
  • informational content related to financial markets

The services are provided exclusively for educational and informational purposes.

WaveMaster:

  • does not provide investment advice
  • does not provide portfolio management
  • does not execute trades
  • does not provide brokerage services
  • does not provide custody services
  • does not provide financial services within the meaning of applicable financial regulatory laws

No content on the platform constitutes:

  • a recommendation to buy or sell financial instruments
  • financial advice
  • investment advice
  • tax advice
  • legal advice
  • solicitation or offering of securities

Users remain solely responsible for all financial decisions.

The Provider is not licensed or supervised by BaFin or any other financial regulatory authority.

3. Eligibility

The Provider may refuse or terminate access at its sole discretion where misuse, legal risk or abuse is suspected.

4. Subscription and Billing

Access is provided through paid subscriptions.

Available plans and prices are displayed on the website.

All prices are final prices. No VAT is charged pursuant to § 19 UStG (Germany).

Subscriptions renew automatically unless cancelled before the next billing date.

Payments are billed in advance for the selected billing cycle.

5. Cancellation

Users may cancel subscriptions at any time through their account settings or by contacting support.

Cancellation takes effect at the end of the current paid billing period.

Already paid fees are generally non-refundable unless mandatory law requires otherwise.

6. Right of Withdrawal (EU/EEA Consumers)

Consumers located in the EU/EEA have a statutory right of withdrawal within 14 days from contract conclusion.

The right expires early if:

  • the User expressly requests immediate access to the digital service, and
  • acknowledges that the right of withdrawal is lost once performance begins.

By activating the service immediately after purchase, the User expressly consents to immediate performance.

7. Refund Policy

Except where mandatory consumer protection laws provide otherwise:

  • all sales are final
  • no guarantee of refunds exists
  • refunds may be granted voluntarily at the Provider's sole discretion

Chargeback abuse, fraudulent claims or payment abuse may result in immediate account termination.

8. Intellectual Property

All platform content, branding, software, analytics, graphics and materials remain the exclusive property of the Provider unless otherwise stated.

Users receive a limited, non-exclusive, non-transferable and revocable licence to access the platform during the subscription term.

Users may not:

  • reproduce content
  • redistribute content
  • resell access
  • commercially exploit materials
  • copy trading systems
  • automate extraction of data
  • share account access

9. Prohibited Use

Users may not:

  • use the platform unlawfully
  • attempt unauthorised access
  • interfere with infrastructure
  • reverse engineer systems
  • use automated scraping tools
  • impersonate others
  • distribute platform content publicly without permission

The Provider may suspend or terminate accounts without notice for violations.

10. Availability

The Provider does not guarantee uninterrupted availability of the platform.

Maintenance, outages, security incidents or force majeure events may temporarily affect access.

The Provider may modify, suspend or discontinue features at any time.

11. Disclaimer of Warranties

The platform and all content are provided "as is" and "as available".

To the maximum extent permitted by law, the Provider disclaims all warranties, including:

  • merchantability
  • fitness for a particular purpose
  • accuracy
  • profitability
  • uninterrupted availability

No guarantee is given regarding:

  • profitability
  • investment success
  • performance outcomes
  • accuracy of market predictions

Past performance is not indicative of future results.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

The Provider shall not be liable for:

  • trading losses
  • investment losses
  • indirect damages

  • business interruption

Liability for slight negligence is excluded except where mandatory law provides otherwise.

Nothing in these Terms excludes liability for:

  • gross negligence
  • injury to life, body or health
  • mandatory statutory liability

The total liability of the Provider shall, to the maximum extent permitted by law, not exceed the total amount paid by the User during the 12 months preceding the claim.

13. Indemnification

Users agree to indemnify and hold harmless the Provider against claims arising from:

  • unlawful use of the platform
  • breach of these Terms
  • violation of third-party rights
  • misuse of content

14. Changes to the Service or Terms

The Provider may update these Terms where necessary due to:

  • legal requirements
  • security reasons
  • technical developments
  • business changes

Material changes will be communicated appropriately before taking effect.

If a User disagrees with updated Terms, use of the platform must cease before the effective date.

15. Governing Law

These Terms are governed by German law excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the User's country of residence remain unaffected where legally applicable.

For merchants and legal entities, exclusive place of jurisdiction is Oldenburg, Germany.

16. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected.
